ABSTRACT
The implementation of the cooperation agreement between PT Pertamina and PT Ankatusaha Kuala Enok was initially carried out in good faith since the contract was signed. Over time, there are rights and obligations that are late to fulfill. This agreement, which also involves the community, causes the problem namely fulfilling achievements but being late in their fulfillment. Therefore the purpose of this thesis research namely to know the implementation of the cooperation agreement of public filling stations (SPBU) Compact Number 16.292.103 between PT Pertamina and PT Ankatusaha Kuala Enok and to know the obstacles and how to solve them in the implementation of the cooperation agreement for the operation of public filling stations (SPBU) Compact Number 16.292.103 between PT Pertamina and PT Ankatusaha Kuala Enok.
The type of this research is sociological legal research or called empirical legal research. Sociological legal research is legal research intended to study and analyze the operation of law in society, which is manifested in the legal behavior of the community. This research was conducted in Kuala Enok Village, Tanah Merah District, Indragiri Hilir Regency. The population and samples in this study were the director of PT Ankatusaha Kuala Enok, representatives of retailers, and representatives of tugboat barge service providers. Sources of data obtained from primary data and secondary data. Techniques in research using interviews and literature studies.
The results of this research are first that the implementation of the cooperation agreement of the Kompak public fuel filling station (SPBU) Number 16.292.103 between PT Pertamina and PT Ankatusaha Kuala Enok is late in fulfilling achievements. Second, the obstacles in the implementation of this cooperation agreement are natural conditions such as tides that cannot be avoided resulting in delays in the distribution of fuel oil, tugboat barges experiencing leaks, tugboat barge service providers are few so that coordination is needed in advance, tugboat barge service providers who have a lot of cargo do not accept cargo if it does not meet the predetermined load. Another obstacle is that the tugboat barge service provider must wait for the cargo of other service tenants in the same direction for one departure. The resolution of the obstacles that occur in carrying out the implementation of this collaboration is that the first party and the second party hold deliberations to reach a mutual agreement.
