Optimalisasi Penegakan Hukum Terhadap Pengendara Sepeda Motor Yang Tidak Menggunakan Helm (Studi Kasus Di Wilayah Hukum Kepolisian Sektor Sipirok Tapanuli Selatan)
ABSTRACT
The use of Indonesian National Standard (SNI) helmets is mandatory for every
motorcycle rider and passenger as regulated in Law Number 22 of 2009 concerning
Traffic and Road Transportation. However, the reality on the ground shows that
the number of violations related to helmet use is still high, especially in the
jurisdiction of the Sipirok Police Sector, South Tapanuli Regency. Data from 2021
to 2023 shows an increase in violations, from 18 cases in 2021 to 35 cases in 2023.
This phenomenon is influenced by several factors such as low public legal
awareness, a disregard for safety, and ineffective socialization of regulations in the
community. As a result, traffic accidents involving motorcycle riders without
helmets often cause serious injuries or even death.
This study uses an empirical legal approach method, namely reviewing applicable
laws and regulations and their implementation in the field. Primary data were
obtained through interviews with Sipirok Police officers and direct observation of
law enforcement in the area. In addition, researchers also analyzed secondary data
in the form of documents, police reports, and literature related to traffic law
enforcement. This approach aims to obtain a comprehensive picture of the
effectiveness of law enforcement, obstacles faced, and optimization efforts made by
the police.
The results of the study indicate that law enforcement against helmet violations
in the jurisdiction of the Sipirok Police Sector has been carried out through several
stages, such as verbal warnings, physical sanctions (push-ups), and ticketing.
However, these efforts have not been fully effective in reducing the number of
violations because there are still major obstacles in the form of low public legal
awareness, driver behavior that tends to ignore safety, and lack of socialization
that touches all levels of society. The author recommends the need for increased
education and socialization, more intensive supervision, and the application of
stricter and more consistent sanctions to increase public compliance with helmet
use regulations for the safety of all.
