Perbandingan Kewenangan Parlemen Di Negara Indonesia Dan Amaerika Serikat

In this research, there are some problems that will be discussed they are : how is the position and competences of parliament in Indonesia and United States of America? How is the comparisons of position and competences Parliement in Indonesia and United States of America.
To get the accuracy data in this research, the writer used research method aas comparisons of law. The kind of this research, that is yuridis normative. The comparisons of law in this research is about the position and competences of Parliement in Indonesia and United States of America that they have the same Bicameral System. Source of data is from the secondary data. The secondary data is classified into three kind. They are Primary Legal Materials, Secondary Legal Materials, and tertiary legal materials. In analizing the data, the writer used deductive thinking that get conclusion according to general cases to be a specific statement.
The result of this research is known that the comparisons the positions and nmcompetences of parliament in Indonesia and United States of America according to this result of the research, it can concluded tah parliament of two country have the same and similarity the number of house and the parliament of two country coming from the direct election. Parliement in Indonesia consist of MPR, DPR and DPD. MPR consist of the member of DPR and DPD. And the one and only that have competences to make a rule in legislatif of Indonesia is DPR. There are weakness competences that DPD have. The competences of DPD is only to make an opinion and consideration about the legislative function. Parliement of United of States of America consist of Congress, House of Representatives and Senate.Congress is the combination between House and Senate. The draft of rule about the tax and fund must be from the House. Senate have a competences to make a deal about the election of head of agencies state. If we make a comparisons between two kind of parliament, and there are many differences. Including the Congress and MPR. MPR is not sure only the joint session of two house, because they have a chairman from itself. And surely have a special competences that make them to be a new agency. Indonesia can be a parliament tricameral. Be different with the congress, that surely the combination of two house. Senate and DPD also have a different competences as the lower house in their system. DPD can be says almost not have a competences because they don’t have the final decisions. The final decisions is only DPR have. Be different woth Senate, that have a powerful competences. Including make a rule, and make a deal about the head of agencies their state.
