In a constitutional practice that happens, a phenomenon that runs over thelast four decades shows trend setting state sitem heavier to the executive (executive heavy). The position of the president as head of state as well as head of government authority are not clear boundaries can evolve toward the negative form of abuse of authority. Existing governmental powers to the president, or referred to the executive power, the consequence was followed by presidential system of government by the Constitution of 1945. This study wanted to be part of
the discourse on the power of government by the President and his powers as Head of State. In the study described and analyzed the power of government and
the President as Head of State, before and after the change in the Act of 1945 is normatively based on the Constitution of 1945. The desire to improve the Indonesian state system towards a better Indonesia, Indonesia has brought the nation to the desire to amend the Constitution of 1945. Academically notion that
the Act of 1945 was amended in fact have emerged that can be found in various publications. But as part of a political agenda is a new idea gained momentum
after the fall of the New Order regime in May 1998.
