Judge appointment selection is actually intended that can generate
qualified judge, can maintain the dignity of judge and has integrity in works. But,
since But, since the constitutional court decision Number 43/PUU-XII/2015 has
released which erased the involvement of judicial commission in judge
appointment selection and inflict any big questions and new problems, the legal
advicer and society doubt with credibility and integrity of judge which generated
by the process of judge appointment selection which just involve supreme court,
included the author. The purpose of this paper is not just explain the urgency of
judicial commission involvement in judge appointment selection process, but it
also want to give a scheme. The new scheme which the author want to explain is
how the society also involve in this selection process be considering that
nowadays, the judge is public officials.
Type of this research can be classified in the type of normative law
research is literature. In this normative law research, the author make the
research against principles of law. The data source is completed by primary data
of analysis result of contitutional court decision number 43/PUU-XII/2015,
Undang-Undang Dasar RI Tahun 1945, Various regulation, decision, and
Secondary data of Literature (book, article, scientific work, journals, magazine
and website), and then tertiary data. In this case used Dectionary of Bahasa and
be treated with qualitative analysis method deductively.
From the result of this research can be concluded that involvement of
yudicial commission is a compulsion to make the judge integrity, maintain the
dignity of judge and generate qualified judges because the the regulatory process
has to be done early through the process of the judge appointment selection so
that be created a new scheme can generate qualified judges, and can increase the
legitimacy or level of trust of society to the judge in decided a case. The
involvement of judicial commission in the porcess of judge appointment selection.
Then, the author also give advice in order to a new scheme which the author
offered, can obtain legal protection as Undang-Undang Dasar 1945, Undang-
Undang, and the regulation which set more specific.
