This study aims to analyze and examine the Police criminal investigation after the Constitutional Court Decision Number 130 / PUU-XIII / 2015 is associated with the Criminal Justice System in Indonesia and find the ideal concept of investigating police crimes after the Constitutional Court Ruling Number 130 / PUU-XIII / 2015 .
This study uses a type of normative research, with data sources are secondary data in the form of primary legal materials, secondary legal materials and tertiary legal materials. The data obtained, both from primary, secondary and tertiary legal materials, is data analysis that is carried out using a statue aproach.
The results obtained from the Investigation of Police Crimes Following the Decision of the Constitutional Court Number: 130 / PUU-XIII / 2015 Associated with the Criminal Justice System in Indonesia that the Investigator is obliged to notify and submit a letter notifying the commencement of the investigation (SPDP) to the public prosecutor, reported and victim / reporter within 7 (seven) days after the issuance of the investigation warrant. In the Criminal Justice System in Indonesia once there is a Notice of Commencement of Investigation (SPDP), the Public Prosecutor has begun to coordinate the progress of the case and start providing input to the investigator.
The ideal concept obtained in this study is due to the absence of legislation governing the provision of sanctions and legal consequences arising from the negligence of the investigator or intentional investigator not to submit a letter notifying the commencement of the investigation (SPDP) to the public prosecutor, reported and victim / reporter so that it is expected that the government through the legislator to make a legal formula for the provision of sanctions and legal consequences caused by the investigator.
