Because the perpetrator of this traffic accident is an underage child, then the loss suffered by the victim can be held accountable to the parents of the child. In other words, the responsibility for damages that can be requested are biological parents / guardians of the child, or adults who live with the child. This research also departs from the experience and Concern of the writer as law enforcers seeing underage children easily driving motorized vehicles on the road, even though an underage child should not be allowed to drive a vehicle, other than because it endangers his life and other people, it is against Law - Law Number 22 Year 2009 concerning Road Traffic and Transportation.
The problems examined in this study are: First, What is the criminal responsibility of children as perpetrators of traffic crimes? Second, Can parents be held accountable for criminal acts of criminal offenses committed by their children?
First Result, Child Criminal Responsibility As Acting Traffic Crime with fulfilling the conditions for the existence of a child's criminal liability, this means that against the child can be subject to punishment, the criminal offense should pay attention to the development of a child. Children involved in traffic accidents that cause the death of the victim must be held accountable for their actions. A child must be responsible for death. Second, the transfer of criminal liability to the parents of children who commit criminal acts of traffic cannot be found explicitly in the process that is responded to by the Criminal Law Law according to the legal rules relating to traffic, related to interpretation and construction to be asked. Assistance or inclusion of criminal offenses is carried out and is accountable for acts of crime committed by related parties related to the transition of responsibility for children who commit acts for crimes committed through the application of diversion. such as parents who are approved regarding additional coverage in the form of compensation or fines for victims
