This study aims to analyze banking services and credit, in the form of Bank Guarantees, one form of an individual guarantee institution, including a debt guarantee agreement. In this study, the focus was on three aspects of the implementation of bank guarantees as a guarantee of projects in financing government projects in Riau Province. How is the responsibility of the parties in implementing the bank guarantee as a guarantee of the project in financing government projects in Riau Province in the event of default? How can legal efforts to overcome default in the implementation of bank guarantees be a guarantee of projects in financing government projects in Riau Province. The legal research method is normative which in this study is a study that focuses on secondary data in the form of written legal norms.
Research results The implementation of the bank guarantee as collateral for government project financing in Riau Province is in accordance with the applicable provisions, but in reality the issuance of bank guarantees is still considered slow by the service providers due to the bank's prudential principle in the bank guarantee process so that documents are required legality and financial services provider companies so as not to cause problems later in the event of default that results in cases. The parties' responsibility in implementing the bank guarantee is a financing guarantee from the government project in Riau Province if default can be seen as the legal relationship of the bank or the applicant from the bank concerned. And all parties are responsible if actions occur against the law and defaults on project financing. Bank rights change to credit status, have the right to conduct checks, supervision of applicants for Bank Guarantees. The obligation of the Bank to issue a bank guarantee, pay claims the party receives a guarantee if guaranteed default. The right of the contractor to participate in the auction or project implementation. The obligation of PT Asuransi Kredit Indonesia provides contra guarantees. Legal efforts to overcome the default of bank guarantee as a government project financing guarantee in Riau Province if there is a claim from the recipient of the bank guarantee that the bank guarantee must be disbursed by the guarantor bank. Submitted by the bank guarantee holder if it does not exceed the period according to the clause. Submit the original document to the bank issuing the bank guarantee. If the publisher or guarantor is forced to pay compensation that is submitted by the bank guarantee holder or bouwheer, the subrogation deed must be made in advance.
