Tinjauan Hukum Kawin Lari Berdasarkan Perspektif Hukum Adat Melayu Riau (Studi Kasus Kawin Lari Di Desa Teluk Piyai Kabupaten Rokan Hilir)

ABSTRACT
In malay society what is meant by an ideal marriage is a marriage that is considered to meet the requrement of cutom, religion, and tradition. The size of the ideal marriage refers to the similiarity of relegion, the similarity of social status in society, the similarity of genealogy, while the size of property is not included in the reference in determining the ideal marriage, because the essence of Malay society is abtinence called ”drunk wealth”,both candidates and their families, especially parents. Problem aries during the marriage preparation process, one of which is if the relationship between the two prospective partners is not approved by the parents of one of the parties, a marriage occurs without the consent of the parents. In this incident, one of them is know as the fact of elopement. The formulation of the problem in writing this thesis : first: what are the factors causing elopement based on Malay customary law in Teluk Piyai Village, Rokan Hilir Regency, second: how is the settlement of elopement in Teluk Piyai Village, Roka Hilir Regency.
This type of research can be classified in the type of sociological juridical research, because this research is carried out at the location or place under study, in order to provide a complete and clear picture of the problem being studied. This research was conducted in Teluk Piyai Village, Kubu District, Rokan Hilir Regency, while the population and sample are all parties related to the elopement problem studied in this study such as elopement actors, traditional leaders and local communities in Piyai Bay, Kubu sub-district. , Rokan Hilir Regency. Sources of data used are primary data, secondary data, and tertiary data, data collection techniques in this study with structured and unstructured interviews and literature study.
The result of the authors’s research in this study are first: the factor that cause elopement are the financing of the marriage ceremony requested by the girl cannot be fulfilled by the bachelor, the girl has not been pemitted by her parents to have a husband, the girl’s parents of familly refuses the bachelor’s application. The main cause of elopement in Teluk Piyai Village, Rokan Hilir Rregency is the absence of the consent of the woman’s parents, which resulted in the application of the man being rejected. Second: in the event of elopement in Teluk Piyai Village, the process of completing the elopement was carried out by gathering the extended families of both parties to conduct deliberation an decide in the fairest way possible, regarding the customary sanctions againts the perpetrators of elopement physically, there was no physical existence and in fact they had been punished by their status social customs for having committed acts that violate customs. The author’s suggestion in this study is that parents should pay more attention to their children and build good commuication, then to the DPH og the Hight Council for the Density of the Four Kenegrian Kubu tribes, in order to give an apply sanctions to the perpetrators, and make rules regarding customary viollation in Teluk Piyai Village, Kubu District, Rokan Hilir Village.
