Implementasi Perlindungan Hukum Terhadap Santri Korban Kekerasan Di Pondok Pesantren Kecamatan Tambang Kabupaten Kampar
Abstract
Children are a mandate and gift from God Almighty. Every child has the inherent dignity, worth and rights as human beings that must be upheld. In terms of national and state life, children are the future of the nation and the next generation of the ideals of nation building, so that every child has the right to survive, grow and develop, be creative, participate, and have the right to protection from acts of violence and discrimination as well as civil rights. and freedom. Child protection in education is something very basic. because in general education is all the efforts of adults in the association of children to achieve physical and spiritual development towards maturity so that they are useful for themselves and society. In Article 54 of Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection, it is stated that (1) Children in and within the school environment must be protected from acts of violence committed by teachers, school administrators or friends – friends in the school concerned, or other educational institutions. Various forms of violence in the school environment are a threat to the implementation of education in Indonesia.
This type of research is classified as a sociological legal research, because in this study the author directly conducts research on the location or four studied in order to provide a complete and clear picture of the problem being studied. This research was conducted at the Pondok Pesantren in Tambang District, while the population and sample were all parties related to the problems studied in this study, the data sources used, primary data, secondary data and tertiary data. Data collection techniques in this study were interviews, questionnaires, and literature review. In drawing conclusions the author uses the method of deductive thinking.
Based on the results of research and discussion can be concluded. First: The forms of legal protection provided in the educational process at Islamic boarding schools are protection of children from ignorance, protection of children from violence, protection of physical and mental health, protection of children's freedom, protection of students in education units. Then it is implemented with the Child Friendly School or Child Friendly Islamic Boarding School program. However, the program has not yet been fully achieved due to the uneven distribution of socialization to Islamic boarding schools in Kampar Regency. Second, the form of law enforcement against unprotected children in Islamic boarding schools is by preventive and repressive measures. The preventive action taken by the Protection and Children Unit of Kampar Regency through the Sat Bimnas carried out an appeal, outreach to schools, the community including Islamic boarding schools regarding child protection. Furthermore, the repressive action taken is that if a report is received, the Women and Children Protection Unit will act according to the established procedures and carry out in accordance with the applicable laws and regulations. However, law enforcement against violence against students still occurs quite a lot, because of obstacles for law enforcers in taking good actions in their preventive and repressive efforts.
