Penegakan Hukum Terhadap Merek Dagang Yang Memiliki Muatan Unsur Pornografi
ABSTRACT
The role of brands in the world of marketing is very important, because
the public often associates a quality or reputation of goods and services with
certain brands. Although the law can be used as a legal basis for imposing
criminal charges against anyone who spreads a brand containing pornographic
elements, until now it is still rare to apply these regulations. This can be seen
from the small number of cases that have been legally processed and of course the
impact on very few criminal charges related to brands that contain elements of
pornography.
This type of research can be classified as normative legal research,
namely legal research conducted by researching library materials. This study
examines the subject matter in accordance with the scope and identification of the
problem through the statute approach, which is carried out by examining the laws
and regulations related to the legal issue under study. In this study the authors
conducted research on legal principles by utilizing descriptive methods. The data
collection technique used in Normative Legal Research is a library research
method, namely using the library as a means of collecting data, by studying books
as reference materials related to the problems to be studied.
The conclusions that can be obtained from the results of the research are:
First, the regulation of trademarks containing pornographic elements based on
Law Number 44 of 2008 concerning Pornography at this time and has also been
regulated in several laws but is still unable to provide prevention and prosecution
of there are still many trademarks that contain pornographic elements that occur.
Misuse of trademarks that contain pornographic elements is still widely found in
several MSME business outlets. Second, the criminal law policy on trademarks
containing pornographic elements based on Law Number 44 of 2008 concerning
Pornography has been expressly regulated but has not been able to provide a
deterrent effect and has not been able to provide prevention against business
actors who abuse trademarks that have legal content. pornographic elements.
