Analisis Yuridis Implikasi Agreement On The Asean Harmonized Cosmetic Regulatory Scheme Terhadap Kebijakan Impor Kosmetik Di Indonesia (Kasus Kosmetik Merek Dnars)
ABSTRACT
Cosmetics trade is included in the free trade (ASEAN Free Trade Area) through
harmonization of technical requirements, recognition of cosmetic registration approvals by
adopting the ASEAN Cosmetic Directive (ACD). Online cosmetic notification is a new system for
registering cosmetic products to representative bodies in each ASEAN country, which can be
done anywhere and anytime online. However, in the case of imported cosmetics trade, there are
still many who are caught by the Indonesian state BPOM who do not have cosmetic notifications
and are also indicated to contain hazardous materials circulating in the Indonesian market.
The purpose of writing this thesis is: First, the implications of the Agreement on the
ASEAN Harmonized Cosmetic Regulatory Scheme (AHCRS) on cosmetic import policies in
Indonesia in the case of Dnars brand cosmetics; Second, efforts to resolve trade cases of imported
cosmetics containing dangerous and unnotified ingredients such as Dnars brand cosmetics. The
analysis carried out is a qualitative analysis or research that is stated in writing.
From the results of the research problem, there are two main things that can be
concluded: First, the implications of the Agreement on the ASEAN Harmonized Cosmetic
Regulatory Scheme (AHCRS) for cosmetic import policies in Indonesia in the case of Dnars
brand cosmetics, that Indonesia implements its national legal policies by deciding and issuing
policies; Second, efforts to resolve cosmetic cases suggested by ASEAN in the ASEAN Cosmetic
Directive, is not implemented properly, because in terms of resolving cases each country does not
follow the advice offered by ASEAN, including Indonesia which uses its national legal policies in
resolving cases of imported cosmetics containing hazardous materials and is not notified by the
way Indonesia does Public Warning. The Author's Suggestions:First, It is hoped that the ASEAN
Organization and the Government of Indonesia can review policies or regulations regarding the
trade in cosmetics in the ASEAN region; Second, it is necessary for all parties involved in
implementing policies in the ASEAN region to ensure the quality and safety of cosmetic products
and improve the quality of their human resources so that supervision of the trade in cosmetics in
the ASEAN region can be carried out properly.
