Perlindungan Hukum Bagi Konsumen Terhadap Standar Mutu Alat Ukur Timbangan Pedagang Di Pasar Bawah Bukittinggi
ABSTRACT
This research is motivated by the existence of problems regarding consumer losses because the scale measuring instrument at Pasar Bawah City of Bukittinggi is not standard. The non-standard measuring instruments for Traders' scales are caused by Traders who do not standardize regularly. Traders also do not provide compensation to consumers because traders think that the measuring instruments they have are up to standard. This contradicts Article 7 letter d with Article 7 letter f of the Consumer Protection Act. Therefore this study aims to find out how the implementation of quality standards and the efforts made by UPTD Metrology on measuring instruments for traders' scales, and find out what is the responsibility of traders if their measuring instruments do not meet quality standards.
The method used in this study is a sociological research type, the nature of this research is inductive and the research was conducted at Pasar Bawah Bukittinggi. The samples taken in this study were forty-two people. Data collection techniques are by questionnaires, interviews and literature study. Data analysis uses the concept of standardization and law enforcement theory which aims to be an analytical knife in this study, so data analysis is carried out qualitatively, namely data based on sentence descriptions. Described and concluded with the method of inductive thinking.
The results of this study indicate that the effect of the low legal awareness of traders and consumers as well as the lack of metrological human resources has caused up to now in Pasar Bawah City of Bukittinggi there are still cases of consumer losses due to non-standard measuring instruments. So it can be concluded that the first, UPTD Metrology is good at implementing quality standards, but many traders do not carry out standardization routinely due to low legal awareness of Pasar Bawah Bukittinggi traders. Secondly, the efforts made by the UPTD Metrological City of Bukittinggi are still not effective due to the lack of Metrological HR, especially Metrological Supervisors to make efforts in the form of counseling, outreach, supervision, and prosecution of non-standard measuring instruments. Third, traders are still responsible for providing compensation to consumers even though traders do not understand standardization. The author's suggestion is that the first is the need for legal awareness from traders to routinely carry out standardization in order to achieve quality standards. Second, it is important for UPTD Metrology to increase the number of Metrological HR so that law enforcement can be effective. Third, traders are required to provide compensation to consumers who are harmed by measuring instruments and for consumers can also strive for effective law enforcement by means of consumers being critical of the rights they have if they are harmed by traders.
