ABSTRACT
Illegal levies are one of the crimes committed by every legal subject, both people and legal entities, directly or indirectly. Illegal levies are disgraceful acts committed to benefit oneself by abuse of power. Illegal levies are a form of crime that is very familiar to the public. Illegal levies are an act of violation of the law regulated in the Criminal Code (KUHP) Article 368 of the Criminal Code and Article 423 of the Criminal Code.So far, law enforcement has been carried outThe Handsome Sector Police, if it is related to the perpetrator, is only limited to securing it, and if it is related to an officer who collects garbage dues outside of his authority, the Handsome Sector Police will continue the case to the investigative level and determine the status of the suspect to the perpetrator or person and hand over the case file to the Attorney. but if the case is only limited to collection by the community/perpetrator, then it will be resolved by deliberation and the return of the collection money to the victim.
The objectives in writing this thesis are: First, to find out law enforcement against perpetrators of garbage collection in the jurisdiction of the Handsome Sector Police. Second, to find out the obstacles faced by law enforcers, especially the Handsome Sector Police against perpetrators of garbage collection. Third, to find out the efforts to overcome the obstacles faced by law enforcers, especially the Handsome Sector Police against perpetrators of garbage dues extortion. The type of legal research used by the author is a sociological legal research. This sociological research is a type of research in terms of legal objectives.
From the results of the study it was found that law enforcement against illegal levies was carried out by certain persons outside the Pekanbaru DLHK officers, namely arrests for 1 x 24 hours and coaching for the perpetrators of the illegal levies. the obstacle faced by law enforcers is that the perpetrators of the crime of extortion do not fulfill the elements in the crime of extortion, namely in the absence of elements of violence or threats of violence. The efforts of the Polsek to keep law enforcement in place, namely in the form of providing direction or outreach to the perpetrators and making a statement that they will not repeat the crime of extortion again. Author's Suggestion, First, Cooperation between the community and the police is further enhanced so that the police can uncover cases of illegal collection of garbage fees that often occur in the jurisdiction of the Tampan Police. Second, it is expected that the police apparatus will make stricter supervision, especially against perpetrators of criminal acts of illegal collection of waste fees. Third, it is hoped that the Handsome Police will add personnel so that they can maximize the strength of the assignment of members in the context of serving the community in order to create public order..
