Analisis Hukum Terhadap Rencana Pembuangan Limbah Nuklir Ke Laut Pasca Terjadinya Gempa Bumi Dan Tsunami Di Jepang
ABSTRACT In explanation Convention On Nuclear Safety 1994(Convention on Nuclear Safety 1994) Article 16 Numbers 1, 2 and 3 that a State that has or will build a Nuclear Power Plant (NPP) in its territory must take appropriate steps regarding facilities, security, emergency plans to be carried out in the event of an emergency around the NPP. However, during the construction of the Fukushima PLTN, the nuclear reactors at the PLTN were built with insufficient power to withstand the Earthquake and Tsunami that occurred in Japan on March 11, 2011, causing explosions and leaks in 4 nuclear reactors. Japan then announced that the tank used to contain the waste from the leaking nuclear reactor could no longer accommodate it, so the waste had to be dumped into the sea. This caused public outrage, not only from the Japanese people themselves who live around the waters but also neighboring countries whose sea borders directly with the State of Japan also protested against Japan's actions. Because nuclear waste is radioactive waste that can be harmful to human health and damage to marine ecosystems. The main issues in this study are: What are the international legal arrangements that were violated by Japan based on its decision to dispose of nuclear waste into the sea; What impact will it have on the environment. The type of research used in this study is normative legal research or also known as doctrinal legal research. Normative legal research is library law research. In this study focused on legal principles. The legal principle used is the principle of expediency.
With regard to the actions that will be taken by Japan who want Disposing of the nuclear waste they have stored for years as a result of the Earthquake and Tsunami has drawn a lot of rejection from various elements. Especially from the Japanese people themselves to protests from neighboring countries who are afraid that the waste will also be affected if it is dumped into the sea. It is hoped that Japan can take appropriate action before doing this because it will not only harm the country but also harm other countries that are disappointed with the actions that Japan will take.
