ABSTRACT
In this era of globalization, the impact of the existence of the internet in buying and selling transactions online as a result of progress in the field of information technology for consumers. The many advantages gained in online shopping have resulted in various online shopping providers popping up, one of which is Shopee. Shopee is said to be an Online Marketplace Provider (OMP), namely an application or website that provides online buying and selling facilities from various sources. Shopee works with goods delivery service companies by implementing a free shipping (postage) program throughout Indonesia with terms and conditions that apply. Delivery services that are integrated with the Shopee system, one of which is J&T Express. In addition to the advantages gained in online shopping, there are also risks that may occur when the delivery of goods appears to be damaged or the goods are destroyed when received by the buyer. The issues discussed are regarding the responsibility of the delivery service company (J&T Express Tampan) if goods are damaged in purchasing goods through the marketplace (Shopee), as well as dispute resolution if goods are damaged during delivery in purchasing goods through the marketplace (Shopee).
The research method of this thesis uses the sociological legal research method, namelylegal research that analyzes and examines the operation of law in society. This research is descriptive in nature. This research was conducted at the Tampan J&T Express branch office, while the population and sample were consumers and employees of the Tampan J&T Express who were related to the problems studied in this study. The data used are primary data and secondary data. Data collection techniques are interviews and literature review. After the data is collected, it is then analyzed qualitatively to draw conclusions.
Based on the research results obtained, it shows thatthe responsibility of the delivery service company (J&T Express Tampan) if there is damage to the goods in purchasing goods through the marketplace (Shopee)in the form of compensation of 10 (ten) times the cost of shipping costs or the price of goods is taken from the lowest value for damaged goods and is not insured or the maximum replacement value is Rp. 1,000,000.00 (one million rupiah). Settlement of disputes in the event of damage to goods in the Shopee application is carried out by means of online mediation, namely by communicating with sellers and buyers in the chat feature available in the Shopee application to confirm damage to goods in delivery by contacting the delivery service. It is hoped that J&T Express and Shopee can maximize their services in order to minimize consumer losses in damage to goods.
