ABSTRACT
Making a work, especially a film, of course involves the producer, director and screenwriter of the story who can also be called the copyright holder. A person's work that has been created will receive legal protection if there are problems related to duplication of the film or copyright by someone other than the creator outside the copyright holder's platform. In this writing the author focuses on the legal protection of copyright holders for duplicating films via the Tiktok application. The purpose of writing this thesis is: First, to find out the forms of losses suffered by copyright holders from duplicating films via the Tiktok application. Second, to find out what legal protection efforts can be taken by copyright holders for duplicating films via the TikTok application. The author conducted research using sociological legal research methods.
This research is classified as a type of sociological legal research with the data sources used, namely primary data and secondary data. As well as data collection techniques in this research using interviews, literature review, and data analysis.
Based on the results of this research, there are two main things that can be concluded: First, the form of loss incurred by the copyright holder is in the form of material loss in terms of the value of a creator's economic rights where material losses can prevent the creator or copyright holder from obtaining royalties on economic use of the results of his creative work. in immaterial form in terms of moral rights, namely violations committed by not including the name of the creator or relating to the use of one's creation on a legal streaming platform, and changing one's creation by uploading video sections of a film on the TikTok application. Second, legal protection efforts that can be carried out by copyright holders are preventive legal efforts, namely by providing educational outreach and awareness for people who still enjoy duplicate film content on the TikTok application by not watching and not sharing duplicate content. films on the TikTok application and on various other social media platforms. and repressive legal measures by filing a civil lawsuit against the IPR investigation team in the form of imprisonment for 5 years or more and can issue a summons in
