Penyelesaian Sengketa Terhadap Kepemilikan Tanah Di Kawasan Hutan Tanaman Industri (HTI) PT Riau Andalan Pulp And Paper (PT RAPP) Sektor Cerenti Dengan Masyarakat Desa Pantai Dan Desa Lubuk Ramo Kecamatan Kuantan Mudik Kabupaten Kuantan Singingi
The need for high land often creates disputes between one party and another over a land. One of the disputes that occurred was a land dispute between PT Riau Andalan Pulp and Paper (PT RAPP) and the people of Pantai village and Lubuk Ramo village in Kuantan Mudik District, Kuantan Singingi Regency. PT. RAPP has land rights through Industrial Plantation Forest (HTI) permits issued by the government. The HTI regulation is regulated in SK 180/menhut-II/2013 dated March 21, 2013. According to SK 180/menhut-II/2013, the area of land that can be managed by PT. RAPP is an area of ±338,536 Ha. PT RAPP has had a HTI permit since 1993 but in 1997 it was known that part of the land that became HTI belonged to PT. RAPP is a rubber plantation owned by the people of Pantai Village and Lubuk Ramo Village based on the sub-district letter dated July 14, 1988 Number 049/pem/98 300. The community asked for compensation from PT. RAPP, therefore PT. RAPP took measurements first with the result of a land size of 184.7 Ha. But unfortunately compensation has not been realized until now. The purpose of this study is to find out how to resolve disputes between PT. RAPP with the people of Pantai village and Lubuk Ramo village, what are the obstacles in resolving disputes between PT. RAPP with the communities of Pantai village and Lubuk Ramo village and to find out the efforts that can be made to overcome obstacles in the implementation of dispute resolution between PT. RAPP with the people of Pantai village and Lubuk Ramo village.
The research method used in this study is Sociology research. This research was conducted in Kuantan Mudik District, Kuantan Singingi Regency. Then the population and sample are some of the parties related to the problem under study, as well as data sources used primary data, secondary data and tertiary data. Data collection techniques in this study are interviews, and literature review.
Dispute resolution that has been carried out is using dispute resolution through mediation and negotiation processes, but the obstacle in dispute resolution is the absence of making a written agreement so that evidence is weak. Therefore, efforts that can be made are to mediate and renegotiate with government involvement in it
