Pelaksanaan Perjanjian Kredit Pada Badan Usaha Milik Kampung (BUMKAMPUNG) Maju Bersama Desa Perawang Barat
Bad credit is a big problem that is considered difficult for BUMKampung Maju Bersama because if this problem occurs, the circulation of money will experience problems. This inability to pay is often referred to as Default. the number of Borrowers at BUMKampung Maju Bersama has increased every year. However, there are still borrowers who, in this case, are people who are late in paying beyond the specified timeframe (due date). Especially during the Covid-19 Outbreak, many people applied for loans to meet their daily needs, and those who made a living as farmers also experienced difficulties in paying their installment obligations to BUMDes. Various reasons for debtors not paying at BUMKampung Maju Bersama are caused by the debtor's uncertain income, for example stolen palm fruit crops, daily shops that are empty of buyers and others.
The type of research used is sociological juridical. In research examining the Implementation of Credit Agreements in Village-Owned Enterprises (BUMKampung) Maju Bersama in West Perawang Village, Tualang District. Primary data sources were obtained through interviews conducted with the Director of BUMKampung Maju Bersama. The data collection technique was carried out through interviews with the director of BUMKampung advanced together, giving questionnaires to borrowers and literature studies.
The results of this study are that the implementation of the credit agreement at BUMKampung Maju Bersama is still not running smoothly. This is caused by several factors, including the lack of awareness of the borrower (debtor) to pay off the installments according to the agreed timeframe. Community understanding of credit agreements is crucial to the smooth process of lending. Efforts to settle defaults in the credit agreement between the borrower and the Kampung Maju Bersama-owned Enterprise are carried out through non-litigation channels, namely through mediation between BUMKampung Maju Bersama and the customer to find the cause of difficulty or negligence in credit payments. Even though the establishment of BUMKampung adheres to the principle of community welfare, it is hoped that the BUMKampung Maju Bersama will be more assertive in taking action against borrowers who default according to the law, namely gradually giving warnings in accordance with the agreement both verbally and in writing, so that the customer does not arbitrarily comply with the agreement.
