This research is related to the implementation of the diskribution of join asests as a resul of divorce (Saolai Cloth Tuun at the Waist) according to Petalangan customary law in the Rawang Empat sub-district, Bandar Petalangan sub-district.
The aim of this research to find out the implementation of the distribution of join assets as a result of a lawsuit divorce (Saolai Cloth Tuun at the Waist) according to Petalangan customary law and haw to resolve the distribution of join assets as a result of a lawsuit divorce (Saolai Cloth Tuun at the Waist) according to Petalangan customary law. This research is a sociological legal research, becaouse it is besed on field research, namely by collecting data from interviews and literature studies that are related to problems using qualitative data analysis, producing descriptive data, and conclusions using deductive thinking methods.
The conclusions that can be obtained from the results of the research are, first, the implementation of the distribution of join assets resulting from a divorce (Saolai Clith Tuun at the Waist) according to the Petalangan customary law has been carried out in accordance with the rules of the Petalangan customary law. However, in the case studied, the wife sued for divvorce becaous of the husbands fault for not providing for her both materially and non-materially and committing domestic violence. Therefore, this should be a consideration for the ninik mamak or tribal chief in deciding the outcome of the division of joint assets in marriage.second, settlement of the distribution of joint assets as a result of a law suit divorce (Saolai Clith Tuun at the Waist) through customary law, namely that women do not receive joint property as a result of a lawsuit divorce (Saolai Clith Tuun at the Waist)this does not fulfill the principles of justice for women. From 2 (two) ceses the implementation of the settlementation of the distribution of joint assets as a result of a contested divorce is carried out by customary law settlement, namely by means of deliberation and from the results of the ninik mamak decision, it is decided that from the wife does not get a division of joint assets, the assets during the marriage belong to the husband and his children.
