Pelaksanaan Eksekusi Putusan Pengadilan Hubungan Industrial Di Pengadilan Negeri Di Pekanbaru
The Industrial Relations Court is a special court formed within the general court environment. This is in accordance with Article 55 of Law Number 2 of 2004 which states; "The industrial relations court is a special court within the general judiciary." The request for execution begins with the submission of the request for execution, the determination of the confiscation of execution, a warning or summons to the respondent, and an auction, for the entire execution mechanism requires costs that are not cheap. referring to Article 58 of Law No. 2 of 2004 concerning Settlement of Industrial Relations Disputes, states that: "In the proceedings at the Industrial Relations Court, the parties involved in a lawsuit are not charged fees, including execution fees, if the value of the lawsuit is less than Rp. 150,000,000,- (one hundred and fifty million rupiah). This is felt to make things easier for the execution requesting parties, because the value of the execution request is below Rp. 150,000,000,- is charged to the State, through the State Revenue and Expenditure Budget (APBN) budgeted by the Supreme Court (MA), if you wish to submit a Request for Execution.
The type of research used is empirical legal research. Empirical legal research is a legal research method that functions to see the law in real terms and examine how the law works in a social environment, so the empirical legal research method can also be said to be sociological legal research.
From the results of research on the problem, there are two main things that can be concluded. First, the implementation of the Industrial Relations Court's decision where the value of the claim is less than Rp. 150,000,000 in the Pekanbaru District Court in reality cannot be implemented in accordance with the provisions of Law Number 2 of 2004 concerning Settlement of Industrial Relations Disputes. There are still many cases where the defendant pays voluntarily. Second, the factors that hinder the execution of Industrial Relations Court decisions where the value of the lawsuit is less than Rp. 150,000,000 because the government's budget has not been released to finance the execution and there is uncertainty about the time period when the execution costs will be disbursed.
