Penyelesaian Tindak Pidana Penganiayaan Ringan Melalui Pendekatan Restoratif Juctice Di Wilayah Hukum Kepolisian Resort Kota Pekanbaru
This research examines the application of the restorative justice approach in resolving minor assault crimes in the jurisdiction of the Pekanbaru City Resort Police. The restorative justice approach is a new concept in criminal law enforcement that emphasizes the restoration of circumstances, reconciliation between victims and perpetrators, and community involvement in the case resolution process. This research aims to understand the implementation of resolving minor assault crimes through the restorative justice approach at the Pekanbaru City Police Resort, as well as identify the obstacles faced in its implementation.
The research method uses empirical juridical research with a sociological legal approach, which studies the influence of society on law and vice versa. The population in this research includes the Head of Criminal Investigation Unit, Investigators, Assault Victims, and Assault Perpetrators in the jurisdiction of the Pekanbaru City Police Resort. The sampling technique uses purposive sampling. Data collection was carried out through direct interviews with respondents and literature review. The data obtained were analyzed qualitatively using statutory regulations, expert opinions, and theories related to the problem under study. The analysis was conducted inductively, seeking truth by starting from specific to general matters.
The research results show that the Pekanbaru City Police Resort has implemented restorative justice in accordance with National Police Chief Regulation No. 8 of 2021 by bringing together victims, perpetrators, families, and community leaders in a mediation process to reach a peace agreement. The mechanisms carried out include receiving reports, investigating, examining witnesses and suspects, offering restorative justice options, facilitating mediation, and following up on peace agreements. This approach is considered quite effective in reducing the number of minor assault crimes, restoring circumstances, and achieving peace agreements. However, its application needs to be reviewed in cases of serious assault that have serious impacts on the victims. In its implementation, the Pekanbaru City Police Resort faces obstacles from legal factors such as unclear regulations and conflicting legal values, as well as societal factors such as third-party interference, unbalanced compensation demands, the influence of modern societal values, and the imbalanced position of perpetrators. To overcome these, the Pekanbaru City Police Resort strives to improve coordination, public understanding, the role of mediators, involvement of parties, supervision, and the quality of law enforcement officers to achieve justice and restoration in accordance with the objectives of restorative justice.
