Construction services are one of the economic activities that have an important role in achieving various targets to support the realization of national development goals. There are two parties in construction services who enter into a legal employment relationship, namely the service user and the service provider. The work relationship between service users and service providers is based on law, and is stated in the form of a construction work contract. A construction work contract contains an agreement between the two parties who are bound to each other and must be implemented in accordance with the articles or agreements that have been stated in the contract. A contract can be said to be an agreement because the contract contains a mutually binding agreement and must be agreed to by both parties. During the implementation of the agreement, if one of the parties breaks their promise then that party can be said to be in default or what could be called a breach of contract.
The method for writing this research was carried out using sociological legal research. This research was conducted in Mandau District, Bengkalis Regency, Riau Province because of data obtained from PT Suka Damai Construction. The author took samples including the Director of PT Suka Damai Construction Rokan Hulu, PT Schintar Marquisa staff, and legal counsel from PT Suka Damai Construction. The data sources in this research are primary and secondary data with primary legal materials, secondary legal materials and tertiary legal materials. The data obtained was collected through interviews and literature review.
Based on the results of research on the problem, there are two main things that will be concluded. Settlement of default on Cooperation Agreement by PT. Suka Damai Construction with PT. Schintar Marquisa began with a cooperation agreement between PT. Schintar Marquisa with PT. Suka Damai Construction regarding the creation of the Anugerah 01 Exploration Well Location and Repair of the Marquisa Block Entrance Road. PT. Schintar Marquisa postponed payment for work to PT. Love Peace Construction. Then PT. Suka Damai Construction has carried out deliberation, negotiation and subpoena efforts against PT. Schintar Marquisa with the aim of solving this problem. However, various efforts made by the defaulting parties remain unresolved. Suggestions for firmness from PT. Suka Damai Construction and, if necessary, take legal action, both non-litigation and litigation, to resolve the breach of contract issue.
