Songs and/or music are art forms protected by law as creations or works in accordance with Article 40 paragraph (1) of the Copyright Law. The Indonesian government has issued regulations regarding royalty payments for the use of songs and/or music in commercial public services. Unfortunately, there has been a disregard for government regulations by a group of cafe business operators, one of which is in Pekanbaru City. Therefore, the objectives of this thesis research are, first, to determine the responsibility for paying royalties to holders of song and/or music copyrights by cafe business operators in Sail District, Pekanbaru City. Second, to find out efforts that can be made so that cafe business operators in Sail District, Pekanbaru City fulfill their responsibility to pay royalties to holders of song and/or music copyrights.
This type of research can be classified as sociological legal research or also known as non-doctrinal legal research. The research location is in cafes located in Sail District, Pekanbaru City, while the population and sample are all parties related to the issues studied in this research. The data sources used are primary data, secondary data, and tertiary data. Data collection techniques are carried out through interviews and literature studies.
From the research results, two main things can be concluded. First, the obligation of cafe business operators to pay royalties has not been maximally implemented. The lack of access for cafe business operators to information regarding the existence of this royalty regulation is one of the main reasons why their understanding and compliance are still very low. Second, the author offers several efforts in order for cafe business operators in Sail District, Pekanbaru City to fulfill their responsibility to pay royalties to holders of song and/or music copyrights, such as the importance of increasing awareness, education and socialization of copyrights as well as the need for support for musicians to manage copyrights.
