Gagasan Pidana Alternatif Bagi Pelaku Prostitusi Jika Di Kaitkan Dengan Tujuan Pemidanaan Yang Humanis

Etymologically, prostitution comes from the word prostitutio which means putting, being confronted, offering. There are also other meanings of selling, peddling, but in general it can be interpreted as surrendering oneself to many kinds of people by obtaining compensation for that person's sexual gratification. Prostitution has existed since ancient times and is one of the oldest crimes in the world and to this day, prostitution still exists as part of society. However, the impact that prostitution has on society is so great that it causes unrest in society. starting from the spread of infectious diseases, places where illegal drugs are sold, the risk of human trafficking crimes, the involvement of minors and so on.
On the one hand, the government is still reluctant to regulate this matter because it is within an individual's personal domain. Indeed, there are already regional regulations, but these regulations still apply within the regional space and for this reason regulations are needed that can be a solution to existing legal needs. The aim of this research is to find out the impact of prostitution and also a humanist solution to prostitution regulations. The research method used is normative legal research supported by secondary data, carried out by using library material as the main focus which is based on library research by taking quotations from reading books or supporting books that are related to the problem being studied. Thus, this research uses secondary data sources consisting of primary secondary and tertiary legal materials.
There are two main results of this research. Firstly, because of the many negative impacts caused by the practice of prostitution, action is needed to criminalize the parties involved, starting from prostitutes, pimps and also users of prostitution services because it is contrary to the norms in society. Secondly, the punishment of prostitution must be carried out in a more humane manner by prioritizing individual improvement so that they do not return to the world of prostitution.
