Implementasi Penjatuhan Sanksi Pembinaan Di Luar Lembaga Terhadap Anak Pelaku Tindak Pidana Di Pengadilan Negeri Pekanbaru
This research examines the implementation of criminal sanctions for guidance outside the institution for children who commit criminal acts at the Pekanbaru District Court. The importance of implementing a rehabilitative approach in juvenile justice, considering the negative impact of detention in correctional institutions on children's development. Coaching sanctions outside the institution are proposed as a more effective alternative, but are often hampered by various factors. This research aims to determine the implementation of institutional development criminal sanctions for children who have committed criminal acts at the Pekanbaru District Court, as well as identifying the obstacles faced in its implementation.
The research method uses sociological legal research, which studies the influence of society on the law and vice versa. The population in this study included Pekanbaru District Court Children's Judges, Pekanbaru District Court's Children's Prosecutors, and Advocates. The sampling technique uses purposive sampling. Data collection was carried out through direct interviews with respondents and literature review. The data obtained was analyzed qualitatively using statutory regulations, expert opinions, and theories related to the problems studied.
The results of the research show that the Pekanbaru District Court in implementing out-of-institution coaching sanctions for children who commit crimes at the Pekanbaru District Court is still far from optimal. Strengthened by evidence that no children have been subject to criminal sanctions outside the institution during the last 4 (four) years. This condition shows that the main objective of imposing sanctions on children who commit criminal acts, namely the recovery and social reintegration of children, has not been fully achieved, as mandated by Law Number 11 of 2012 concerning the Juvenile Criminal Justice System. In implementation, the Pekanbaru District Court faces several obstacles, namely the lack of a budget, unwillingness from the family to facilitate children, the lack of facilities or collaborating institutions, justice for victims, government commitment in implementing criminal sanctions for children, lack of socialization and public understanding and uncertainty in law enforcement.
