Tinjauan Yuridis Urgensi Keberadaan Motif Dalam Memutus Perkara Tindak Pidana Pembunuhan Berencana

Premeditated murder or moord is a form of crime against life regulated in Article 340 of the Criminal Code. For this article to be imposed, a motive is required. In one of the cases in decision Number 777/Pid.B/2016/Pn.Jkt.Pst, Jessica Kumala Wongso, who in the decision, was charged under Article 340 of the Criminal Code which ignored valid evidence and the perpetrator's motives. The aim of this research is firstly to find out what aspects are taken into consideration in charging the death penalty against perpetrators of the crime of premeditated murder. Second, to determine the urgency of the existence of a motive in the death penalty indictment against the perpetrator of the crime of premeditated murder.
The type of research used in this research is normative juridical legal research or can also be called doctrinal legal research. Normative juridical legal research is library legal research. This research uses qualitative analysis which produces descriptive data.
The results of this research examine the analysis that the judge's considerations regarding Decision Number 777/Pid.B/2016/Pn.Jkt.Pst in the Jessica Kumala Wongso case applied Article 340 of the Criminal Code and sentenced him to 20 years in prison. The judge's considerations in decision Number 813 K/Pid/2023 applied Article 340 of the Criminal Code, Article 49 in conjunction with Article 33 of Law Number 19 of 2016 in conjunction with Law No. 11 of 2008 concerning ITE in conjunction with Article 55 paragraph (1) to 1 of the Criminal Code and sentenced life imprisonment. Article 340 of the Criminal Code requires a motive because Article 340 of the Criminal Code is a material offense where the consequences arising from intentional actions are prohibited consequences. Motive is a necessity in Article 340 of the Criminal Code, because in Article 340 of the Criminal Code it is a deliberate/intentional act.
