Implementasi Pasal 6 Peraturan Daerah Kota Pekanbaru Nomor 10 Tahun 2000 Tentang Izin Rumah Makan Di Kecamatan Pekanbaru Kota
This study aims to analyze the implementation of Article 6 of Pekanbaru City Regional Regulation Number 10 of 2000 concerning the obligation to have a business license for restaurant entrepreneurs in Pekanbaru Kota District. The research background is based on the phenomenon of many restaurants operating without obtaining permits in accordance with the provisions of the Regional Regulation. This raises questions about the effectiveness of the implementation of licensing policies and the factors that hinder them in the field.
This study uses an empirical legal method with a sociological juridical approach. The data sources consist of primary data obtained through interviews with the Head of DPMPTSP Pekanbaru City, the Head of the Riau Province Tourism Office, as well as licensed and unlicensed restaurant owners in Pekanbaru Kota District. Secondary data were obtained from literature studies on laws and regulations, literature, and related documents. Data analysis was carried out qualitatively to obtain a comprehensive picture of the implementation of licensing policies.
The results show that the implementation of Article 6 of Regional Regulation Number 10 of 2000 in Pekanbaru Kota District is not optimal. Only 23 out of 80 restaurants have business licenses. Constraints faced include lack of socialization and understanding of entrepreneurs, burdensome requirements for MSME actors, and the length of time for processing permits. Although DPMPTSP has made improvement efforts such as intensifying socialization, simplifying requirements, and implementing an online system, these measures need to be further optimized through a thorough evaluation of the substance of the Regional Regulation, strengthening DPMPTSP capacity, developing an incentive system for compliant business actors, increasing cooperation with stakeholders for assistance, as well as involving public participation in licensing supervision, in order to create a more orderly, fair and contributing restaurant business climate to the regional economy.
