Pelaksanaan Restrukturisasi Perjanjian Kreditantara Bank Sinarmas Dan Nasabah Di Kota Pekanbaru
ABSTRACT
Republic of Indonesian Financial Services Authority Regulation Number 19 of 2022 concerning special treatment for financial services institutions in certain regions and sectors in Indonesian affected by disasters article 5 paraghraph 3 point b, namely the article regulates credit or financing restructuring pilices. The problem that occurred in this research was that there were 20 customers who experienced bad credit because these customers were not given restructuring from the creditor, namely Bank Sinarmas. The purpose of this research is to determine the implementation of credit agreements and the implementation of credit agreement restructuring between Bank Sinarmas and customers in Pekanbaru City.
This research is sociological legal research, where researchers approach the influence of non-legal factors on the formation of positive legal provisions. The object of this research is the Pekanbaru branch of Bank Sinarmas. The population related to this research is Bank Sinarmas Pekanbaru Branch, as well as customers who did not receive restructuring from the creditor. The method used in this research sample is a random method, namely interviewing Bank Sinarmas Pekanbaru Branch and customers who have bad credit at Bank Sinarmas Pekanbaru Branch.
From the research results, it was concluded that the factors causing default/bad credit in Credit Agreement Number 27 Deed dated 27 August 2018 between the creditor, namely Bank Sinarmas, and the debtor, namely Mr. Alizar Ali, were: (1) Economic factors, where the debtor was Mr. Alizar Ali experienced a decrease in income from the restaurant business due to Covid-19. (2) External Factors, where Bank Sinarmas violated the regulations of the Republic of Indonesia Financial Services Authority Regulation Number 19 of 2022 concerning Special Treatment for Financial Services Institutions in Certain Regions and Sectors in Indonesia Affected by Disasters in Chapter 3 paragraphs 2 and 3, where in this regulation banks apply special treatment to debtors affected by natural disasters with policies to improve asset quality and credit or financing restructuring. Settlement efforts taken as a result of default/bad credit in Credit Agreement Number 27 Deed dated 27 August 2018 between the creditor, namely Bank Sinarmas, and the debtor, namely Mr. Alizar Ali, by means of the creditor reviewing the debtors who did not obtain the restructuring policy by means of go to the field to see the conditions of debtors affected by natural disasters.
