ABSTRACT
Product returns are one of the significant issues in online transactions. In the context of e-commerce, returns often become a complex issue for both buyers and sellers. The main issue in this study concerns product returns (retur) made by buyers through Shopee marketplace platform, where the returns do not comply with the agreed-upon policies, resulting in losses for the seller. In the case studied by the researcher, The buyer violates Law Number 8 of 1999 concerning Consumer Protection, Article 5 and Article 6, regarding consumer obligations and business actors' rights. This research aims to analyze the legal protections available to sellers in product returns, provide a better understanding of the return process within the Shopee e-commerce platform, and describe the strategies sellers can adopt to address similar issues.
The research method used in this study is sociological research with a library research (literature study) approach, employing a socio-legal methodology. The primary references used include legislation, interviews with Shopee sellers, and Shopee’s terms and agreements.
The research findings indicate that, as of now, there are no specific regulations in Indonesia that provide legal protection for sellers in online transactions. Sellers who suffer losses due to buyers can only refer to other related regulations on sales transactions. The product return mechanism also has shortcomings, as there are still loopholes that allow buyers to commit fraud. Shopee's mediation team has also yet to perform optimally in determining the outcomes of appeals filed by sellers. This research is expected to provide insights for sellers and the Shopee e-commerce platform to improve seller and buyer satisfaction while reducing intentional return rates.
