Legal aid is an important instrument in the criminal justice system and secured as part of the framework of constitutional rights of citizens to obtain access to justice in order to face the power and authority given by the state. Legal aid is one of the efforts to fill the human rights and is one of the elements to justice for everyone, especially for the poorest sections of society as a party that is unable and often received other forms of injustice law are evident. lawful.
The enactment of Law No. 16 of 2011 on Legal Aid is one of the government's efforts in providing access to justice (acces to justice) and equality before the law (equality before the law), especially for the poor and those who are marginalized.
Legal Aid Institute (LBH) Pekanbaru is one of the legal aid organization that stands in the city of Pekanbaru which is also one of PD's office who are members of the Indonesian Legal Aid Foundation (YLBHI) moves uphold legal justice for justice seekers. Indeed LBH Pekanbaru role in improving access to justice (acces to justice) for the community, especially the city of Pekanbaru is to help the poor and the marginalized and fight for their rights before the law to uphold the human rights values.
The author conducted empirical research juridical or sociological research using data collection techniques such as; interviews, questionnaires and review of the literature in order to obtain secondary data of primary legal materials and then secondary law and continued with the primary data collection in the field, and analyze theories and legislation with the facts on the ground.
From the research results can be concluded that the LBH Pekanbaru has not been able to carry out its role optimally because they are constrained in terms of financial, that does not have sufficient funds to provide legal assistance free of charge to the poor poor and marginalized, so it is still far short of expectations people. It is expected that the central government and local government can allocate sufficient funds from the state budget and the budget to penyelanggaraan Legal Aid for free (pro bono publico).
