Perlindungan Konsumen Atas Promosi Usaha Melalui Sms (Short Message Service) Oleh Pelaku Usaha Kepada Calon Konsumen
Advances in the field of information and communication technology is something that we should be grateful, One of the products of the sophistication of information and communication technology is a cellular phone. The feature that is very often used by consumers in using mobile phones is SMS (Short Message Service) service. Advantages of SMS (Short Message Service) is itself a cheap tariff. Consumer is any user of goods and / services that must be protected by law and every business actor shall not violate the rights of consumers. Consumer rights to be fulfilled by business actors are regulated in Act No. 8 of 1999 on consumer protection. Including business promotion through SMS (Short Message Service) is often done by business actors to potential customers through the card provider used by consumers. Consumers also have an obligation to protect themselves from business promotions through SMS by other business actors to their prospective customers in order to achieve the objectives to be achieved by consumer protection law.
Based on the understanding of the authors formulate two formulation of the problem that is: First felt terganggukah consumer with the promotion of business through SMS (Short Message Service) by business actors to prospective customers. Secondly, can consumers make a lawsuit for business promotion through SMS (Short Message Service) by business actors to prospective customers.
This type of research can be classified in empirical legal research or also known as sociological law research, because this research conducts research of spaciousness. The research location and population along with the sample in this writing is on the students of Law Faculty of University of Riau which is located in Pattimura Kecamtan Sail Street Pekanbaru. Sources of data consist of primary data and secondary data, data collecting techniques through interviews and distributing questionnaires to consumers / customers as respondents and discussions to consumer dispute settlement agencies (BPSK) as practitioners in the field.
Based on the results of research, there are two main things that can be concluded the right of consumers to get the comfort and security of the SMS (Short Message Service) promotion and consumers are very disturbed by the existence of it. Secondly, the violation committed by the consumer business is entitled to take a class action suit and protect itself from the promotion of the business via SMS (Short Message Service). Suggestions, consumers are expected to be more intelligent and active and can protect itself from things that can harm consumers. Besides, it is expected that the coaching and training of consumers as well as the supervision and enforcement of government law in providing protection to consumers from business actors that have harmed the consumer.
