Larangan Perkawinan Sesuku Sekampung Sepucuk Adat Di Kenagarian Aia Manggih Kabupaten Pasaman Sumatera Barat
ABSTRACT
Adat is a reflection of the personality of a nation, is one of the incarnations of the soul of the nation concerned from the century abab. For the people of Indonesia, the law that becomes the benchmark for behavior is customary law. Customary law is considered as a rule of life to achieve peace in society. One of the rules in customary law is marriage. Marriage is a taboo birth bond between a man and woman as husband and wife with the aim of forming a happy and eternal family based on the Godhead of the Almighty. However, not all marriages can be carried out even though they have fulfilled the agreed terms and conditions. In the Aia Misticated Kenagarian district of Pasaman, West Sumatra, there was a prohibition on having a marriage of a tribe as a traditional village. The existence of this prohibition is caused by several factors and also some very bad effects for the perpetrators, families and even their descendants later. The formulation of the problem in this thesis, namely: First, what are the factors causing the prohibition of the marriage of a tribe of the Seventh-day Traditional Village in the Aia M Advanced Kenagarian District of Pasaman, West Sumatra? Second, are there any inheritance level restrictions for the prohibition of marriage of Sesuku Sekampung Sepaduk Aden Dikenagarian Aia M Sophisticated, Pasaman Regency, West Sumatra?
This type of research is a sociological juridical research, because in this study directly conducted research at the site in order to provide a complete picture and type of the problem under study. This research was conducted by Kenagarian Aia M Sophia, Pasaman, West Sumatra, while the population and sample were all parties concerned with the problems examined in this study, the data sources used were prime data, secondary data and terie data. Data collection techniques in this research were interviews and literature study.
From the results of the study, there are three main things that can be concluded. First, the reason for the prohibition of such marriages is because of the principle of Minangsawah Nan Bapamatang (Minang rice fields and rice field bunds). And also some of the factors that cause it to be banned, such as disability in religion, loss of customary rights, severed bloodlines, fears of marriage between siblings, educating shame and obeying the vows of ancient ancestors. Secondly, there is no limit on the level of offspring to do a marriage of a tribe in a village in the Aia M Sophia district of Pasaman, West Sumatra, even though it has already passed through several subsequent progeny or descendants.
