ABSTRACT
Expert testimony is one of the evidences in the criminal procedure code as regulated in Article 184 paragraph (1) of the Criminal Procedure Code. Expert statements play an important role in resolving criminal cases. Without the presence of an expert in providing or explaining problems, it is conceivable that investigators will have difficulty in trying to uncover crimes, especially high-dimensional crimes such as terror and bombing, burning / fires, environmental pollution, computers, counterfeiting of money, mutilation. However, what is happening right now is that there is a lawsuit against the expert who has given his statement in the resolution of criminal cases in the Court. The problem raised in this study is how the legal protection of experts who provide information in court.
The research method used is the normative legal research method. Sources and types of data obtained from secondary data obtained from various literature studies as well as legislation, books, literature relating to the problem of this research.
Based on the research results of the discussion it can be concluded (1) Legal protection of experts according to Law No. 31 of 2014 concerning Protection of Witnesses and Victims has not provided clear protection so as to create a gap for certain individuals to sue an expert. (2) Protection regarding expert statements in the future needs to be reaffirmed in the relevant laws as well as providing legal certainty for an expert providing information in criminal cases especially Article 10 of Law No. 31 of 2014 concerning Protection of Witnesses and Victims.
Suggestions in this paper are needed the renewal of the law governing the protection of an expert, especially the renewal of Law No. 31 of 2014 concerning Protection of Witnesses and Victims, In addition to the protection of experts, it requires clearer and more extended statements regarding the rights of an expert.
