ABSTRACT
With regard to the cooperation agreement, Article 1320 of the Civil Code applies to the terms of the legality of the agreement, where in the cooperation agreement an agreement between the parties occurs. The agreement between the two parties means giving rise to the rights and obligations of each party involved in the agreement. The agreement applies or binds the parties making it as stated in Article 1338 of the Civil Code. The problems examined in this study, namely the implementation of the Jambi Province road supervision cooperation agreement between the Directorate General of Highways and PT. Arteri Cipta Plan and the consequences if one party defaults on the other party. This writing uses sociological research methods that intend to provide a detailed, clear and basic description of the problem under study.
Judging from the type, this research is classified as sociological research and can also be said as field research that examines the applicable legal provisions and what happens in reality in the community or in other words a research conducted on the actual reality in the community. Judging from its nature, this writing is analytical descriptive, which means that the research is intended to provide a detailed, clear and systematic description of the main problems of the study. In this study using two primary data sources and secondary data.
Based on the results of the study it can be concluded that the Work Package Agreement for Technical Supervision of Preservation of BTS Kerinci Road - Bts. West Sumatra and Within the City of the River Full of Specific Non Vertical Work Units Planning and Supervision of the Jambi Provincial National Road and PT. Arteri Cipta Rencana Jo PT. Raissa Gemilang has been made with due regard to the law of the agreement and is binding for both parties. Implementation of the Work Package Agreement for Technical Supervision of Road Conservation in Kerinci BTS - Bts. West Sumatra and Within the City of the River Full of Specific Non Vertical Work Units Planning and Supervision of the Jambi Provincial National Road and PT. Arteri Cipta Rencana Jo PT. Raissa Gemilang was not carried out properly because there were several obstacles in its implementation. PT. Artery Cipta Jo's Plan. PT Raissa Gemilang has defaulted by not fulfilling the obligations stipulated in the contract.
