Politik Hukum Pembentukan Satuan Tugas Penanganan Covid-19 Dalam Sistem Ketatanegaraan Indonesia

ABSTRACT
Currently, the world and Indonesia are also experiencing the same
problem, namely experiencing a pandemic by the corona virus (Covid-19), in
Indonesia itself in facing and breaking the chain of spread of the corona virus
pandemic, one of them is the formation of a task force by the president. . The next
thing is related to the position of BNPB in handling Covid 19. Based on
Presidential Decree Number 7 of 2020 as amended by Presidential Decree
Number 9 of 2020 concerning the Task Force for the Acceleration of Handling
Corona Virus Disease 2019 (COVID-19), the President has formed an
Acceleration Task Force. Handling of Corona Virus Disease 2019 (Covid-19),
however, with the issuance of Presidential Regulation Number 82 of 2020
concerning the Committee for Handling Corona Virus Disease 2019 (Covid-19)
and National Economic Recovery, the Task Force has changed into a Task Force.
This type of research can be classified in the type of Normative legal
research, which reveals legislation relating to legal theories that are the object of
research. The approach taken uses a qualitative analysis approach by looking for
data both in books, journals and other scientific works related to this research.
The data sources used are primary and secondary legal materials.
The conclusions that can be drawn from the results of the research are:
First, the legal politics of establishing the Covid-19 Task Force used by the
government, namely using the articulation of the interests of this function is a
process of determining the desired interests of the political system. This means
that the government declares their interests to political institutions that are
formed together to have the same interests. Second, the ideal concept of the
Covid-19 handling task force in the Indonesian constitutional system, namely the
governmental political sphere, namely the pattern of life of the state supra
structure or patterns and relationships between formal institutions and the actual
government mechanism or the socio political sphere, namely regarding the
pattern of circumstances and life. infrastructure, or patterns and real relations of
socio-political institutions in the state government mechanism, these two things
must always be in tune and in harmony, including: patterns of adjustment,
patterns that deviate and completely new patterns. Third, legislative oversight of
the government's performance through the Covid-19 Task Force in handling
Covid-19 cases has not been maximized, which is a factor that is not yet optimal
in the oversight role of the DPR as a legislative institution, this can be related to
the reduction of the DPR's supervision budget during the pandemic.
