Penyelesaian Sengketa Tanah Pusako Tinggi Antara Ahli Waris Kaum Makboed Dengan Forum Nagari Tigo Sandiang Di Kecamatan Koto Tangah Kota Padang
ABSTRACT
This high inheritance land dispute occurred between Lehar the heir of the
Makboed and the community in Koto Tangah District, Padang City. The beginning
of this dispute occurred because Lehar as the heir of the Makboed made a claim
that the land owned by his predecessor was 765 hectares. However, the land owned
by the Makboed is only 2.5 hectares and that too is in the Dadok Tunggul Hitam
village. Meanwhile, the community of Koto Tangah Subdistrict has approximately
3,005 Ownership Certificates (SHM), 391 Building Use Rights (HGB) certificates,
55 Land Use Rights certificates and has been occupied by approximately 50
thousand families. There are also people who own land based on court decisions
that have permanent legal force, such as the heirs of Ranggale based on Landraad
Decision Number 53 of 1929.
The type of legal research is sociological juridical, which in this research,
is carried out by going directly to the field to collect primary data, and using
descriptive methods. Meanwhile, if viewed from the nature of this research is
descriptive.
The results of this study are the factors causing the occurrence of high
pusako land disputes between the heirs of the Makboed and the Nagari Tigo
Sandiang Forum in Koto Tangah District, Padang City, namely: a) Differences in
interpretation of land rights between the predecessors of the Makboed and Nv.
Exploitatie Van Onroerende Goederen, b) The decision on bail confiscation of the
Class I A Padang District Court which contradicts the Lanraad Decision No.
90/1931, c) Misinterpretation of data from the heirs of the Makboed regarding the
ownership of the disputed land area, d) Complaints from the people of Koto Tangah
Padang District which have never been followed up by the Padang BPN. The
process of resolving the high pusako land dispute between the Makboed heirs and
the Nagari Tigo Sandiang Forum in Koto Tangah District, Padang City through:
a) non-litigation channels, namely ninik mamak-ninik mamak, Koto Tangah
District united and formed the Nagari Tigo Sandiang Forum (FNTS) in defending
customary rights of the community, then FNTS filed a complaint and made a report
to the relevant agencies regarding the high pusako land dispute starting from the
Ministry of Agrarian Affairs and Spatial Planning, OMBUDSMAN RI, BPN to the
police., b) litigation, namely by filing a lawsuit to the court but all claims filed by
FNTS was rejected by the court. In 2020, the Minister of Agrarian Affairs and
Spatial Planning/National Land Agency and the Padang City Land Office, have
lifted the blocking of land objects located in 4 Kelurahan in Koto Tangah District,
Padang City based on the Order of the Land Office of Padang City No:
UP.02.01/390 -13.71/III/2020 dated March 30, 2020. Also the issuance of the Map
of the Land for the Object of the Case as stated in the Landraad Decision Number
90/1931.
