ABSTRACT

Agreements in the form of unwritten or oral agreements in general tend to be considered as weak agreements considering that oral agreements are more difficult to prove because they are easy to be denied by the promised party when compared to written agreements with clear clauses, in an agreement for the maintenance of cattle in general. the community holds it in the form of an oral agreement so that it is not clearly proven the things that are the rights and obligations of each party. The purpose of this thesis research; first, to find out the implementation of the cattle husbandry agreement in the Koto Cengar community, Kuantan Singingi Regency, second, to find out the implementation of the cattle husbandry agreement based on customary law in the Koto Cengar village with the principle of justice.
The type of research used is the sociological method, namely research carried out directly on the location or in the field to obtain data in order to provide a complete and clear picture of the problem being studied, in this study a population of 16 people was determined with a sample of 7 people consisting of the owner and community members. Cattle keepers and the Head of Koto Cengar Village, Kuantan Singingi Regency.
From the research results it can be seen that; first, in the implementation of the agreement for the maintenance of cattle in Koto Cengar Village, Kuantan Singingi Regency, it can be said that it has been running optimally. In the pre-agreed terms, that the maintenance process, profit sharing, and even compensation will be carried out according to the initial agreement. In accordance with the agreed provisions between the owner and the custodian that the profit sharing is in line with the concept of the agreement. Second, the implementation of the cattle husbandry agreement based on customary law in Koto Cengar Village, Kuantan Singingi Regency can be said to be in accordance with the principle of justice.
In accordance with the provisions of customary law there that the sound is divided, allies are allowed. Suarang means division and ally means joint ownership. The meaning of the word, the implementation of cattle maintenance between the owner and the keeper. The owner has a brood cow and then it is handed over to the keeper, then it will be cared for and cared for by the keeper to produce offspring. The first offspring or the first calf that is born then it belongs to the owner, then if a second offspring is born then it will belong to the keeper. However, if the offspring of the cattle being kept are still 1 head and there is an urgent need or an important situation on the part of the keeper, then the calf can become the property of the keeper, provided that if the cow being kept gives birth to the next calf, then the calf it belongs to the owner.
