ABSTRACT
One of the most popular social media is Twitter. On Twitter, many autobase accounts distribute immoral content and have many followers. Even though Law Number 11 of 2008 has formulated criminal provisions regarding the distribution of immoral content, in reality, law enforcement is still lacking. The formulation of the problem in this research is: 1) Does the alleged perpetrator of the crime distribute immoral content through the autobase Twitter account? 2) law enforcement against the perpetrators of the Twitter autobase account managers who provide access to upload immoral content?
This type of research is normative juridical research with a legal principle approach. Data analysis through a qualitative approach. The results of this study are as follows: the criminal responsibility of the perpetrators of distributing content contained in the autobase Twitter account is sentenced to a maximum imprisonment of 6 years and/or a maximum fine of Rp. 1.000.000.000,00 by the provisions of Article 45 paragraph (1) jo. Article 27 paragraph (1) of Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008. Law enforcement has been carried out by law enforcement officers, namely the Police against autobase account managers who provide access to distribute immoral content by establishing an IT Sub-directorate & Cyber Crimes that are stored to prevent, anticipate and combat cyber crimes, carry out (sweeping), conduct counseling about the dangers of pornography and criminal sanctions. Law enforcement from the Ministry of Communication and Information by blocking immoral content, established a Forum for Handling Internet Sites with Negative Content, and operated a machine for censoring negative content on the internet. However, law enforcement has not yet shown maximum results. This can be seen from the many autobase accounts that provide access to distribute immoral content.
