ABSTRACT
Land disputes often occur because one of the parties feels that their interests
have been harmed or they feel that their rights have been taken away. This dispute
can be resolved by litigation (court) or non-litigation (out of court). The parties
have the freedom to choose which path will be taken to resolve the case. However,
if the community is in a customary law environment, usually the dispute will be
resolved by custom first.
The objectives of the writer of this thesis: first, to find out how the
implementation of land pawning in Nagari Tiku, Tanjung Mutiara sub-district,
Agam district. Second, to find out how to resolve land pawn disputes according to
customary law in Nagari Tiku, Tanjung Mutiara District.
This research is classified in the type of sociological research, because the
author directly conducts research on the location or point being examined to
provide a complete and clear picture of the problem under study. This research
was conducted in Nagari Tiku, Tanjung Mutiara District, Agam Regency, while
the population and sample were all parties related to the problems studied in this
study, the data sources used, primary data and secondary data, data collection
techniques in this study with literature review interviews. and data analysis.
From the results of the study there are several things that can be concluded.
First, in Nagari Tiku, Tanjung Mutiara District, the Regency has two kinds of
pagang pagang, namely pagang pagang using gold and pagang pagang using
money. Some have a timeframe, some don't. Pagang pawn which has a period of
time is called pagang susuik. there are still many people in Nagari Tiku who carry
out pagang pawn agreements using oral. Second, there are many pagang pawn
agreements that last for decades and even pagang pawns continue to the
descendants of the parties who do pagang pawns. Which is a problem in the
future when the heirs want to complete a pawn agreement. Second, there are two
kinds of pagang pawn disputes in Nagari Tiku, Tanjung Mutiara sub-district,
namely those that are only resolved by mamak and some are resolved by the
Nagari Customary Density (KAN).
