Penegakan Hukum Terhadap Modifikasi Becak Bermotor Tanpa Uji Tipe Di Kepolisian Resor Kota Pekanbaru
ABSTRACT
It is often found that modified motorized vehicles and assembled vehicles operate on public roads, both carrying passengers and goods, such as mini-trains, motorcycle tricycles, trailer-mounted motorbikes that are not accompanied by a vehicle number sign and documents that match the vehicle indicating that The vehicle has not yet registered. However, in this case, law enforcement for these incidents is generally not enforced due to weak law enforcement caused by certain factors. The purpose of this study was to determine law enforcement against motorized tricycle modifications without a type test, and to find out the obstacles faced by law enforcers and to find out the efforts made by law enforcement officers at the Pekanbaru City Police.
This type of research can be classified in the type of sociological juridical research, because in this study the author directly conducts research on the location or place under study in order to provide a complete and clear picture of the problem being studied. This research was conducted at the Pekanbaru City Police, while the population and samples were the Head of Traffic and Transportation of the Pekanbaru Dishub, the General Head of Traffic Tickets at the Pekanbaru Police and some Motorized Pedicab Drivers in Tampan District, Pekanbaru City. Sources of data used are primary and secondary data sources, data collection techniques are observation, interviews and literature study.
From the results of the study, the authors conclude that modifications to motorized rickshaws are legal or allowed as long as in accordance with the provisions of Article 50 of Law Number 22 of 2009 concerning Road Traffic and Transportation, Indonesian National Police officers have the authority to enforce motorized rickshaws operating in road for violating Law No. 22 of 2009 concerning Road Traffic and Transportation. Then the form of violation of modifications to motorized tricycles in the jurisdiction of the city of Pekanbaru includes forms of specifications that are not appropriate and often interfere with other motorists, the obstacles that occur in the field are the low number of accidents that occur in motorized tricycles, the absence of a warrant from superiors and lack of awareness, then the law enforcement efforts still have no firm action expected in dealing with the perpetrators of these violations. The author's suggestion is that the Department of Transportation should be able to spark a policy that is able to regulate the existence of motorized tricycles in the city of Pekanbaru so that the realization of order for motorized tricycles, then drivers and rickshaw users are expected to comply more with the rules that have been applied and must care about applicable regulations.
