Diskriminasi Pengupahan Pekerja Perempuan Indonesia Ditinjau Dari Ilo Convention No. 100 On Equal Remuneration Convention
ABSTRACT
Equal pay for male and female workers for work of equal value refers to the value of wages determined without discrimination based on sex. The rule is written in ILO Convention No. 100 on The Equal Remuneration Convention. Even though this regulation is regulated, in reality women workers still earn 23% lower wages than men workers. Global data released by UN Women also shows that there is an estimated 16% gender pay gap of which women only get 77 cents of the 1 dollar earned by men for work of the same value.
The purposes of this study are : First, to find out the international legal arrangements regarding the provision of equal wages between males and females worker, Second, to determine the implementation of equal pay between male and female workers in Indonesia, and Third, to determine the forms of gender inequality in providing wages to female workers in Indonesia.
The author conducted this research using a normative research method or library research which discusses the level of synchronization of legal regulations in Indonesia with the ILO Convention No. 100 on Equal Remuneration Convention. From the research problems above, there are 3 main things can be concluded. First, the legal arrangements regarding wage protection are contained in international conventions. Specifically, regarding the equality of wages between males and females, it is regulated in the ILO Convention No. 100 on Equal Remuneration Convention, Second, the implementation constraints regarding the provision of wages come from a lack of understanding of awareness about the right to receive wages as part of human rights as a whole and several supporting factors can then occur through technical obstacles, and Third, the form of injustice that occurs in the provision of wages to female workers is the gender pay gap and labeling (stereotype).
