Air transportation is a fast and economical means of transportation. In addition, air transportation can cover a wide range with a relatively short travel time and at a price that is still affordable for the public, as well as the security and comfort provided.To regulate air transportation the international community has created an international organization, namely the International Civil Aviation Organization ( ICAO) was created during the Chicago Convention of 1944. Article 44 states that the ICAO's aim is to develop principles and techniques for international air navigation. Article 3 bus of the Chicago Convention recognizes that the prohibition on the use of weapons is only for Civil Aircraft In Flight. State aircraft especially military aircraft do not enjoy this kind of protection under international law.
This type of research can be classified in the type of normative research. This research uses research methods on the principles of international law. Research on legal principles is carried out on legal principles which are benchmarks for inappropriate behavior or behavior. Research on legal principles is a philosophical study, because legal principles are an ideal element of law. This research is descriptive analysis, which describes and analyzes the problems that have been raised to describe the review of the International Civil Aviation Organization in handling cases of shootings of civilian aircraft in conflict areas associated with international air law.
From the results of the research and discussion it can be concluded that, First, international civil aviation, especially when crossing conflict zones while the Civil Aviation Convention (known as the Chicago Convention) establishes a civil aviation investigation framework, does not provide a suitable legal and institutional framework for accountability, Secondly to the role of the ICAO as a specialized agency of the United Nations which from time to time is asked to deal with contentious issues at the request of its Signatory States, it is inevitable that some decisions should be made about ICAO should refrain from violations. parameters of international politics in its diplomatic efforts.
