Pelaksanaan Perjanjian Bagi Hasil Tanah Antara Pemilik Dengan Penggarap Sawah Di Desa Temusai Kecamatan Bungaraya Kabupaten Siak
A profit-sharing agreement is an arrangement between a landowner and a cultivator, where the cultivator is granted the right to manage the land, and the proceeds from this management are divided according to the agreement reached by both parties. The community of Temusai Village has engaged in such agreements, leading to issues where the landowner refuses their share of the land’s yield and breaches the agreement. The landowner appears to hold control, whereas in this agreement, the landowner and cultivator should hold equal positions. The writer's focus on the imbalance between the landowner and the cultivator. The principle of balance is crucial in agreements, as it views both parties as being in an equal position, with no dominant side, allowing for negotiation. This ensures that the goal of balancing rights and obligations can be achieved.
The research method used in this study is sociological research, which relies on facts gathered directly from the subjects' circumstances. These include verbal responses obtained through answered questions, as well as actual situations observed directly.
The research results indicate that the implementation of profit-sharing agreements by the community tends to be standardized, leading to a disruption in the balance between landowners and cultivators. The study found that the principle of balance was compromised from the outset of the agreement, but neither the landowner nor the cultivator recognized this at the time. It wasn't until after the contract period, when an issue arose, that the cultivator realized the imbalance between themselves and the landowner.
