Tanggung Jawab Pemberi Waralaba Terhadap Penerima Waralaba Atas Merek Usaha Waralaba Yang Tidak Terdaftar Di Kota Pekanbaru
Franchising is a business model in which the owner of a brand or business system (franchisor) grants the right to another party (franchisee) to run a business using a proven brand, system and operational method. One of the requirements that must be met is that the Franchisor before entering into an agreement with the Franchisee must register the franchise offering prospectus as stipulated in Article 10 of Government Regulation No. 42 of 2007. After the application is submitted, the minister in the field of trade will later issue a Franchise Registration Certificate (STPW). The Franchise Registration Certificate (STPW) is proof of registration of the franchise offering prospectus for Franchisors and advanced Franchisors and proof of registration of the franchise agreement for Franchisees and advanced Franchisees given after fulfilling the specified registration requirements.
The purpose of this study is to understand the implementation of legal protection against franchisees for unregistered franchise business marks and do not have STPW in Pekanbaru City and understand the legal consequences for franchises with unregistered franchise marks and do not have STPW in Pekanbaru City. The type of legal research used by the author is a type of sociological legal research. Sociological legal research is research that wants to see the correlation between law and society, so as to reveal the effectiveness of the enactment of the law, while the population and sample are all parties related to the problem under study. This research uses data sources in the form of primary data and secondary data, with data collection techniques carried out by interview.
From the results of the problem research, the legal consequences for franchises with unregistered brands and not having a Franchise Registration Certificate (STPW) in Pekanbaru City will result in the agreement being null and void so that the clauses of the agreement related to the franchise cannot be implemented. In addition, franchisors will potentially face administrative sanctions from the trade office, including fines and even operational termination. Meanwhile, the responsibility of franchisors towards franchisees for unregistered franchise business brands in Pekanbaru City is currently not fulfilled. This is due to the lack of awareness of the franchisor who has caused harm to the franchisee.
