Pelaksanaan Perjanjian Jual Beli Buku Pada Pt Penerbit erlangga Mahameru Di Kabupaten Kampar

ABSTRACT
An agreement according to Article 1313 of the Civil Code is an act by
which one or more people bind themselves to one or more people. A sale and
purchase agreement creates rights and obligations between the seller and the
buyer, the seller has an obligation to provide goods and receive payment for an
item and vice versa for the buyer. PT Penerbit Erlangga Mahameru and Pondok
Pesantren Al-Badr have a cooperation agreement to procure books with a
maximum procurement of IDR 100,000,000. PT Penerbit Erlangga Mahameru
has carried out its obligations but Pondok Pesantren Al-Badr has not fulfilled its
obligations to make payments in accordance with Article 7 of the cooperation
agreement so that PT Penerbit Erlangga Mahameru suffered losses from this
action. This study aims to determine the implementation of the book sale and
purchase agreement between PT Penerbit Erlangga Mahameru and Pondok
Pesantren Al Badr and the inhibiting factors in the implementation of the
agreement.
The research method used is sociological/empirical legal research,
namely by conducting interviews with PT Penerbit Erlangga Mahameru, the head
of the Kampar Unit and the Head of Administration of the Al-Badr Islamic
Boarding School as a data collection tool. In this study, the author conducted
direct research at the research location to obtain materials, data and information
related to this research.
The results of this study are that the Al-Badr Islamic Boarding School did
not fulfill the agreement on the cooperation agreement that had been agreed
between PT Penerbit Erlangga Mahameru and the Al-Badr Islamic Boarding
School. Factors that influence the failure to fulfill the agreement are caused by
internal factors, namely the system by the Islamic Boarding School which lacks
assertiveness. External factors are the economic factors of the parents of students
and the presence of students who drop out. This problem was resolved through
negotiations between the two parties who agreed to be resolved in 2024.
