Problems related policies lately quite a few are processed and charged under the Corruption Act, giving rise to polemics. Polemic about whether or not entangled with the criminal policy, until now still leaves the issue. If any policy can be qualified as a crime of corruption, it would be a dilemma. Known fact, that the policy is part of a system, if a government official fear of taking a policy, the wheels of government will not run as expected.
The purpose of this study, to determine criminal liability system in Indonesia and to determine the criminal liability of state administration officials on policies that an act of corruption.The research was done by using a normative approach that the principles of law.
The data used in this research is to use secondary data that primary legal materials (Law 1945, the Law, and the Penal Code, secondary legal materials (books relating to the results of the study the death penalty in corruption and data from the internet) and tertiary legal materials (Indonesian Dictionary), data collection techniques in this study with the literature study and analysis of the data by using the deductive method is a way of drawing conclusions from the arguments that are specific to the general.
Criminal responsibility a person against a crime that happened not in spite of the existence of the elements of criminal liability relating to the offense makers themselves, which among others include the ability of responsible, errors in the broad sense and not any excuse and justification. error element is the main element or elements in the principal criminal responsibility . Persons who have committed a criminal act can be held accountable for criminal acts against him in a criminal if it did have an element of error. State administration officials who made a policy if the setting of the policy contains elements of abuse of authority or policy behind the enactment of the officers unlawfully and have malicious intent (mistakes) intentionally want to make a profit for yourself or others and may cause harm to the financial then state policymakers may be liable.
