Illegal import medicine distribution will endanger its consumers health and safety because there is o safety, efficacy and quality guarantee of Badan POM (The National Agency of Drug and Food Control). Therefore, Articles 106 (1) of the Healthy has state pharmaceutical preparation and healthy tools just can distribution has been licensed. but, in reality still encounreted without a marketing authorization of medicanal products circulating in the community and can get at drugstores and pharmacies. The problems of this thesis, are: First, how law enforment against criminal acts on import medicine that do not have a license by investigators civil servant Balai Besar POM Pekanbaru (Provincial office of Drug and Food Control in Pekanbaru)?, Second, what are the constraints on law enforcement against criminal acts on import medicine that do not have license by investigators civil servant Balai Besar POM Pekanbaru (Provincial office of drug and food control in pekanbaru)?, Third, how can the efforts to overcome the constraints encounteredin law enforcement against criminal acts on import medicine that do not have license by investigators civil servant Balai Besar POM Pekanbaru (Provincial office of drug and food control in pekanbaru)?
This type of research can be classified of sociological juridical research, because in this research the author directly conduct research on the locations or point examined in order to provide complete and obvius about the problems examined. This research conducted in Balai Besar POM Pekanbaru (Provincial office of drug and food control in pekanbaru, some pharmacies and dgrustores in Pekanbaru and customs and excises in Pekanbaru, while the population and sample are parties related to the problems examined in this research. Source of data used, data primer, data sekunder and data tersier, data collection technique in this research are questionnaire, interview and literature review.
The results of this research there are three main things that can be inferred. First, law enforcement by Balai Besar POM Pekanbaru not run optimally. Because Balai Besar POM Pekanbaru less intensity in monitoring drugs that still found a merchant who sells medicine without license and severity of sanctions given to the perpetrators. Second, the obstacles faced by Balai Besar POM Pekanbaru are derived from internal factors and external factors. Third, effort by Balai Besar POM Pekanbaru in overcoming the obstacles faced in tackling the drug that does not have a license in Pekanbaru are additional staff, sanctions to businesses and socialization by ULPK. Advice writer, first, more optimal supervision and increasing intensity of supervison by Balai Besar POM Pekanbaru, Second, improve cooperative relationship with related parties, third, improve role the ULPK.
