Vigilante actions (eigenrichting) in Indonesian criminal law can be categorized as a crime of persecution, therefore, required the efforts of law enforcement in terms of provision of criminal liability against any perpetrators of vigilante (eigenrichting). But in practice, there was no imposition of criminal liability altogether by police Resort Siak against perpetrators of vigilante (eigenrichting) in the jurisdiction of Police Resort Siak.
As for the purpose of this research is to investigate the implementation of the criminal responsibility of the perpetrators of vigilante (eigenrichting) in maltreatment in the jurisdiction of Police Resort Siak, then to find out what are the constraints faced in the implementation of the criminal responsibility of the perpetrators of vigilante (eigenrichting) in maltreatment in Siak district police jurisdiction, and to know what is being to overcome obstacles in the implementation of the criminal responsibility of the perpetrators of vigilante (eigenrichting) in maltreatment in the jurisdiction of Police Resort Siak.
This research includes research into the socio-juridical consistent with the fact that life in society. While the nature of this research is descriptive which gives a clear and detailed picture of the problems studied. The data used are primary data collected directly from the field, as well as secondary data derived from primary legal materials, secondary and tertiary. Means of data collection through interviews, questionnaires, and a review of the literature. In the analyzes carried out by means of qualitative and deductive method of thinking.
Results of this study is that administration of the criminal responsibility of the perpetrators of vigilante (eigenrichting) has not been conducted in accordance with the legislation by the Police Resort Siak, because there are some obstacles. Factors that there are two constraints, namely internal factors and external factors. The efforts made to overcome one of which is to increase the number of personnel down to the crime scene as well as provide insight directly to the public that any vigilante (eigenrichting) was prohibited by law.
