Protection of the rights of suspect in the investigation is the examination process rights investigation is the examination process rights owned by a suspect who restrained of liberty within certain time, where the application of the rights of suspects is extremely important because of concerns with the problem of enforcement and protection of the right of other. Although there have beenn specific rules governing the rights of the accused but in fact the field is stiil no case of violation of the rights of suspects conducted by law enforcement officers in the process of examination of the case in the Police Resor Indragiri Hulu. The purpose of this thesis research is, namely; first, implementation of protection of the rights of suspects in the investigation process of investigation, second, constrants faced by the police, third, the efforts of the investigators.
This type of research can be classified in this type of juridical sociological research. This research conducted at the Police Resor Indragiri Hulu and a detention class two B Rengat, while population and sample an entire party is related to the problems examined in this study, sources of data used, primary data, tertiary and secondary data, data collection techniques in this study with the observation, interviews and literature study.
First, Implementation of protection of a suspect in the investigation process of investigation has been going according to regulation in accordance with book of the law of criminal procedure law, Second, Contraints faced by the police investigator is the lack of knowledge in this investigation and action uncooperative suspects,Third, the efforts of the investigator is to provide additional education for investigators, SOP for conducting and strict sanction on person who not professional investigator in performing duties. First, to the investigator in conducting the presumption of innocence. Second, to the suspects should provide information honestly and not beating around the bush so that the inspection process an run well. Third, in order to avoid violation of the suspect during the investigation process inspection it is expected that government should make strict sanction for the individual investigator.
